Mt. Baker breach settlement sets $3.3M patient fund

The proposed settlement covers a January 2025 ransomware incident involving Mt. Baker Imaging and Northwest Radiologists, with claims due by August 19, 2026.

A $3.3M non-reversionary settlement fund has been established in a proposed class-action settlement involving Mt. Baker Imaging and Northwest Radiologists.

The case, filed in Whatcom County Superior Court, concerns a ransomware incident that affected Mt. Baker Imaging, LLC and Northwest Radiologists, Inc., P.S. between January 20 and January 25, 2025.

The settlement website states that cybercriminals accessed and exfiltrated personally identifiable information and protected health information belonging to plaintiffs and about 340,184 class members.

Washington Attorney General data breach records list Northwest Radiologists, Inc./Mount Baker Imaging with a January 20, 2025 breach date and 348,118 Washingtonians affected.

Settlement class members may claim reimbursement for documented out-of-pocket losses of up to $5,000.

Class members may also seek a pro rata cash fund payment from the net settlement fund after approved claims, medical identity-theft protection and monitoring, notice and administration expenses, fee and expense awards, and service awards are paid.

The settlement also offers 2 years of Medical Shield Complete medical identity-theft protection and monitoring through CyEx.

Plaintiffs alleged that the defendants failed to implement and maintain necessary data security safeguards. The defendants denied wrongdoing and liability but agreed to settle to avoid the risk and expense of continued litigation.

The long-form notice also states that the defendants will improve their data security and maintain those business-practice commitments for 5 years. The notice lists $500,000 in business-practice security enhancements as part of total settlement benefits of about $3.8M.

The court granted preliminary approval on April 21, 2026. The claims deadline is August 19, 2026, and the final approval hearing is scheduled for August 21, 2026, at 1:30 p.m. PT.
