California poisoning case involving radiologist dismissed

An Orange County Superior Court judge dismissed the indictment against dermatologist Yue “Emily” Yu, MD, PhD, in a criminal case involving her former husband, radiologist Jack Chen, MD.

The Orange County District Attorney’s Office said it planned to refile the case, according to local reporting citing prosecutors.

Yu had pleaded not guilty to felony charges after prosecutors alleged that she put drain cleaner into Chen’s drink.

The judge dismissed the charges after finding problems with the grand jury process, including evidence the defense said was not presented to jurors.

Defense attorneys have denied the allegations and argued that the claims arose during a divorce and custody dispute.

The district attorney’s office disputed the defense position and said it would continue pursuing the case.

Yu’s California medical license remains active, according to reporting on the case.
